On Wednesday 31 January 2024, United States Senator Ben Cardin and Representative James McGovern introduced the Human Rights Defenders Protection Act of 2024, a bill that seeks to protect Human Rights Defenders (HRDs) facing retaliation globally for defending human rights and democracy. Notably, Senator Cardin was also the author of the Global Magnitsky Human Rights Accountability Act, which established one of the most comprehensive sanctions regimes for human rights violations around the world. If passed, the HRDs legislation will not only strengthen the US Government’s ability to prevent, mitigate and respond to attacks levelled against HRDs, but also enhance their protection through the establishment of an interagency framework for supporting HRDs that will remain in place across subsequent administrations. Moreover, if the bill ultimately became law, it would send a strong signal of institutional backing for the protection of HRDs worldwide, a protection that is much needed at a time when defenders face mounting threats and risks. Among such risks, HRDs face death and physical threats, they are subject to smear campaigns, intimidation, arbitrary arrests, torture, enforced disappearances, and murder. In 2022 alone, over 400 defenders were killed around the world, although the real figures are estimated to be considerably higher, but remain limited due to lack of transparency and underreporting.

Ecological responsibility and consumer rightsThe growing call for ecologically responsible consumer choices, driven by greater awareness of the environmental and social consequences, is impacting consumer rights. This study explores the rights of consumers amid the mobility transition from ownership to usership within the circular economy. By means of an analysis of specific EU directives and their implementation in the Netherlands, Belgium, Germany, and France, this study analyses whether, and to what extent, the protection of consumers of mobility usership is equivalent to that of consumers in traditional sales contracts. Furthermore, it includes an empirical analysis of the level of self-regulation within the Member States, consisting of a comprehensive analysis of the general terms and conditions of providers of mobility usership. Consumer protection in mobility usershipThe findings suggest that inequivalent protection exists for consumers of mobility usership due to both the ratione personae and ratione materiae scope of the directives. Although inequivalences may not necessarily pose significant problems, a mutatis mutandis assessment of the rules is important to consider the ratio legis of the legal rule, while ensuring that the rule remains proportional and practically possible. Abstract In this introductory article, we critically analyze which rules govern human mobility and how mobility regulations and codes are resisted, transgressed, broken, and remade. To play by the rules of mobility means to follow habits and laws governed by social norms and institutional control. Our point of departure is that social and institutional mobility rules both abound and are intertwined and that they are routinely disputed by individuals, groups, and institutions. Drawing on ethnographic examples and the literature on legal anthropology, mobilities, and transnational migration, the article disentangles the specific mechanisms, principles, and symbolic power of mobility rules—written and non-written, legal and non-legal, formal and informal, codified and non-codified, explicit and implicit. In short, we address how people are navigating rules of mobility that operate in contradictory, ambiguous, and hidden ways.
